How Do I Terminate A Buyer's Agent Agreement? | Rock-n-Roll Real ...

Q: I would like to know if I can terminate a buyer agreement I signed that is binding for a year. I am not happy with the agent and how she conducted herself when we went to view the property for the second time. Furthermore, she did not inform the listing agent it was our second viewing, she was late, did not hand the owners her business card until asked and had brought her husband to the appointment. She also did not consult with us all options regarding the offer we made. We did not counter-offer the sellers. Thanks.

A: Read the Buyer?s Agreement that you signed as it would disclose under what (if any) conditions it can be terminated prior to its expiration. And well, discuss your concerns with the agent, ultimately it doesn?t benefit either of you to be ?stuck? with each other. Best of luck.

A: You would have to consult with your attorney. If you signed a contract, you are bound to it. I would personally ask the managing broker to see if you can get out of it before lawyers are involved. Maybe they will ask if you wouldn?t mind using a different broker in their office. But I would go that route first.

Clearly you are not happy with your agent, though some of your complaints do not seem serious enough to warrant termination. Your agent is not obligated to inform the listing agent of the second showing nor to provide her business card prior to the asking.

May I suggest you ask to have a meeting with your agent and his/her supervising broker to discuss your issues and see what are the best options to address either improving the relationship or terminating the agreement.

A: You should be able to terminated the agreement with a letter of cancellation/termination. Read your agreement, usually either side can terminate. Make sure you get a signed termination from the Realtor.

A: This is a contract between you and the agency (brokerage), so I would contact the broker of her office to discuss issues with performance and defaulting on the contract terms. The broker may be able to assign you a different agent or to terminate it altogether. IF that doesn?t yield you with results you want then you need to talk to a lawyer about defaulting on the agreement.

In my business I have a ?tear it up? clause for The Grumbles Team as a buyers agent. I figure if you are not happy with me then you are not going to buy and you can always ?wait? out the expiration of the contract to sign with another agent and buy with them. I can?t make you submit offers so why hold you in an agreement that you want out of . Life is to short for a conflict at this level.

Hope that you get the resolution you are wanting, but make sure that you have your reasons for wanting to terminate clearly defined up front. For example her husband may have tagged along as a safety measure, either on this showing or even on an earlier client that day before your meeting. So communication about these items is the key with any relationship with a Realtor and their client.
