GAAR: India May Not Go For Retro-Taxing Of Overseas M&A

A committee which was formed to give recommendations on the implementation of the controversial general anti-avoidance rules (GAAR) provisions in India released its draft guidelines Thursday night. The draft guidelines have clarified that the GAAR will not be applied retrospectively.

GAAR, which was introduced in the budget in March, has been much criticized by the industry and investors for its anti-investment friendly provisions. The new tax rules, intended to eliminate tax evasion by companies by routing their investments through tax havens, lacked clarity in several aspects and investors feared its misuse.

The provisions in GAAR like retro-taxing created panic among investors that reflected in Indian capital and Forex markets through the high foreign fund outflow. Though the government deferred its implementation by a year to 2013, it virtually spoiled the investor sentiment towards the economy.

In the draft guidelines issued Thursday, the government sought to allay the investors' concerns over retro-taxing and other issues.

On Invoking the GAAR and Retro Taxing provisions: The ministry's draft guidelines clarify that there won't be any retro-taxing and GAAR provisions will be invoked only if a Foreign Institutional Investor (FII) opts to take advantage of tax treaties.

"Where an FII (foreign institutional investor) chooses to take a treaty benefit, GAAR provisions may be invoked in the case of the FII, but would not in any case be invoked in the case of the non-resident investors of the FII," says the draft guidelines.

The ministry has also suggested having an income threshold for invoking GAAR while making clear that "the provisions of GAAR will apply to the income accruing or arising to the?taxpayers on or after 01.04.2013."

Interplay between SAAR and GAAR: Allaying concerns that there can be interplay between the Anti-Avoidance Rules (SAAR) and Specific General Anti-Avoidance Rules (GAAR), the draft guidelines said: ?"While SAARs are promulgated to counter a specific abusive behavior, GAARs are used to support SAARs and to cover transactions that are not covered by SAARs. Under normal circumstances, where specific SAAR is applicable, GAAR will not be invoked. However, in an exceptional case of abusive behavior on the part of a taxpayer that might defeat a SAAR, as illustrated in Example No. 16 in Annexure E (or similar cases), GAAR could also be invoked." ?

On the Application of Section 96(2): One of the contentious provisions in GAAR was that even if only a part of the business arrangement is to obtain a tax benefit, the tax authorities will treat the whole arrangement as an impermissible arrangement, according to section 96(2).

However, now the draft guidelines recommend that "where only a part of the arrangement is impermissible, the tax consequences of 'Impermissible Avoidance Arrangement' will be limited to only that part of the arrangement."

The draft guidelines are not yet seen by Prime Minister Manmohan Singh, who assumed the charge of the Finance Ministry after Pranab Mukherjee resigned from the post. Finance ministry sources have revealed that the guideline will be finalized in consultation with the Prime Minister. However, with Singh making it clear that he would make all efforts to get back the foreign funds and revive economic growth, the concerns over the provisions of GAAR are expected to be addressed soon.?

Analysts expressed satisfaction over the government move to clarify on GAAR.

"Some clarifications are a welcome step. It remains to be seen how the guidelines are implemented," said N. C. Hegde, a Mumbai-based partner at Deloitte Touche Tohmatsu India, according to a Bloomberg report.

The government's initiative to sort out the concerns over GAAR is crucial in regaining the FII confidence. Experts feel though there still exists some doubts on the provisions of the controversial act, steps taken now are in right direction towards clearing them.?

If you believe in UFOs, you may be in better company than you think.

Thirty-six percent of Americans -- about 80 million people if the survey applied to the whole country -- believe UFOs exist, and a tenth believe they have spotted one, a new National Geographic poll shows.

Seventeen percent said they did not believe in UFOs, or Unidentified Flying Objects, and nearly half of those surveyed said they were unsure. Perhaps reflective of today's political climate, there appears to be near-universal skepticism of government ? nearly four-fifths of respondents said they believe the government has concealed information about UFOs from the public.

The study, commissioned in anticipation of National Geographic Channel's "Chasing UFOs" series premiering Friday night, was not all serious, said Brad Dancer, National Geographic's senior vice president for audience and business development. Respondents were asked whether President Barack Obama or Republican challenger Mitt Romney would handle an alien invasion better (Obama won 65 percent in that contest) and which superhero they would call in to fight off the attack (the Hulk beat out Batman and Spider-Man).

"We were trying to have a little fun and see if pop culture references have had an impact on people's beliefs," Dancer said. "It's intended as a fun survey of public opinion."

Hollywood, he added, may have contributed to the belief ? held by 55 percent of Americans, according to the study ? that Men in Black-style agents threaten people who report UFO sightings. As movies portraying aliens become increasingly convincing, they may subconsciously affect people's attitudes, he said.

A growing number of Americans have come to believe that Earth is not the only planet in the universe hosting life, he said. The study showed that 77 percent of Americans believe there are signs that aliens have visited Earth.

While the study may be used as ammunition by the vocal minority of UFO enthusiasts, Dancer said that it leaves open the precise definition of the term UFO.

"UFO doesn't necessarily mean alien spacecraft," he said. "There are things that are unexplained. They're interesting because they're unknown. People love a mystery."

The study, conducted by the polling firm Kelton Research, found that more Americans believe "The X-Files" best represented what would happen if aliens invaded Earth than any other movie.

The study, in which a random sample of 1,114 Americans 18 and over was surveyed, also asked what respondents would do if aliens visited Earth. Nearly a quarter said they would try to befriend the extraterrestrials, 13 percent said they would lock themselves indoors, and just one in 20 said they would "try to inflict bodily harm."

Those numbers did not surprise longtime UFO investigator David MacDonald, director of the non-profit Mutual UFO Network, who said the idea of contact with extraterrestrials has become commonplace in the last few decades.

"We have grown up with 'Star Trek,' 'Star Wars' and 'Battlestar Galactica,'" MacDonald said. "We're at the point where we'd say 'What planet are you from? Oh well, let's have a beer.'"

(AP) ? Rescue workers equipped only with hand-held tools gave up their search Tuesday and waited for bulldozers to arrive to help find some 100 people who residents said were missing after landslides struck Uganda's mountainous east.

Residents who survived the natural disaster stared at the quickly hardening red sludge the day after massive landslides hit the eastern district of Bududa. A government official called the region a "death trap" and said the government would move out residents.

Government officials have not released a death toll, but the Uganda Red Cross said it has confirmed 18 deaths. But some villagers in a place called Bunamulembwa, one of the villages swept by massive landslides in the eastern district of Bududa, said close to 100 people ? mostly children? were missing.

"It is feared the landslides and floods buried about 29 homes with about 30 people," Stephen Mallinga, Uganda's minister for relief and disaster preparedness, said in a statement Tuesday. "We cannot as of now establish the exact number of homes and people buried."

Workers and volunteers who dug at the mud with machetes and hoes said the job was frustrating.

"The mud is just too deep," said Hannington Serugga, a rescue worker with an aid group called Samaritan Emergency Volunteers' Organization. "We have tried our level best (to retrieve bodies) and we have failed. This really is a challenge."

Michael Solo, a man who said he lost his four children in the landslides, pointed to the spot where he suspected they were buried. He said his house was one of 17 buried in the neighborhood.

"I used to love this place," Solo said. "But now I want to go. I just want to go."

Villager Alice Bunyolo said her brother had lost his wife and two children.

"My brother, I feel bad for my brother," she said.

Another man who said he lost his entire family cried as he gazed to the sky, offering his dirty handkerchief and praying for a miracle.

Landslides have struck this rugged part of eastern Uganda at least once each year since March 2010, when rain-induced landslides killed about 100 people and destroyed everything from a church to the village market.

Sometimes the landslides are minor, killing a few livestock and injuring a few people. But at times they bury whole villages alive.

Bunyolo told the story of a young man who was out cutting grass for his cow when he heard a strange sound and saw the ground moving. The man ran east, and after the landslide the western part of what had been a green hill was covered in mud, homes buried.

Musa Ecweru, a junior minister for disaster preparedness, was mobbed by villagers after he arrived in Bunamulembwa with no bulldozers. Villagers asked him what the government was going to do to help them. He said bulldozers were coming but was not sure when they would arrive.

"The local tools cannot manage," Ecweru said. "We can't act on emotions. We can only do what's possible."

Officials say the threat from landslides is not over and that 400,000 people living on the edges of Uganda's Mount Elgon are likely to be displaced by torrential rains. For years the government has failed to persuade villagers to move to safer places; local activists say it would be a cultural disaster if the people left their ancestral homes.

Ecweru said the government would now forcibly evict those villagers deemed most vulnerable to landslides.

He described the place as a "death trap," saying disaster would happen again.

I have been teaching sexuality for so long and over the years when I ask people--women in particular--what they think they need in order to feel sexually empowered, without reservation, the number one answer I get the most is "I want more confidence" or "I want more sexual confidence." My conclusion? Most people want more confidence!

Coming from a place of insecurity, which is the opposite of confidence, doesn't feel good and usually does not get you what you want.

It's very hard, if not impossible, to create the relationships of your dreams from a place of insecurity. Without a healthy dose of confidence, you have a really hard time standing up for yourself or asking for what you need in your relationships, and sometimes you get walked all over because of it. Not fun.

It's hard to build a really successful business or career from a place of insecurity. If you are feeling frustrated because your career feels stagnant or you are playing small and not taking steps to do the work you feel you are here to do in the world the way to change it is to have the confidence to do it. It's so painful to watch how people play small and keep themselves from having their dreams.

It's hard to ask for the money you deserve from a place of insecurity. Maybe you want a raise, or you want to raise your prices if you have your own business and you lack the confidence to ask for what you know you are worth.

It's definitely hard to get the sex and the sexual satisfaction you want and deserve from a place of insecurity. You might be feeling sexually frustrated, not having orgasms, not feeling like you get as much from sex as your partners, or feel stuck in not being able to ask for what you need sexually and so you aren't getting it. I find that many people who are powerful in other areas of their lives, (particularly women) just lack the ability to get their needs met in the bedroom and often feel really small and dissatisfied there.

Confidence is often talked about like it's a pill you can take, or like it's something you acquire in one big shot and you are good. But it's not. It's something you have to work at. It's a process to develop confidence.

This is why I began to look at people's confidence and scrutinize how their confidence operates . . . I know from all my years of work that there are patterns around people's ways of expressing and using their confidence and I've learned a few things about what makes people tick, what their needs and fears are, and what will help them get to the next level in their life, love, work and play.

I developed the 5 Confidence Types? out of my work with people. You may have a clear dominant type or you might be a combination of types. Most people do have a dominant type that is your home base right now--your default or the place you are most comfortable, or uncomfortably comfortable. You can learn skills to help you bring more of the energy of some of the other types into your repertoire if you want that, and you can also work on understanding how your type operates so you know what to work on enhancing and what to be careful of.

I want you to find out what your Confidence Type? is! This is not a one-size fits all operation. We don't all operate with the same brand of confidence. We have varying strengths and vulnerabilities and I want to help you define where you are now and how to move your confidence to the place where you want to go. Per Scholas Brings Technology Education to the South Bronx ...

To bridge the digital divide, the Per Scholas Institute for Technology in the South Bronx provides a no-cost IT training program to prepare low-income high school graduates for entry-level jobs in corporate IT departments.

The digital divide today has vastly changed from the first dot-com bubble in the 1990s. What used to be a dichotomy between those with computers and those without, now has become a divide between the ?tech-savvy? and those who have the tools but are missing the basic technology skills needed for an entry-level job.

Per Scholas, a nonprofit organization located in the South Bronx, aims to bridge that divide. Founded in 1995, Per Scholas has worked to bring computer access to low-income families in the city?s poorest congressional district. Now it has grown into the Per Scholas Institute for Technology, an IT workforce development program that helps low-income high school graduates and adults learn computer technology and train to become IT technicians in the corporate world. It trains about 450 students a year.

The program runs for 15 weeks, five days a week, with one day per week dedicated to workplace and communication skills, and resume building. Prospective students can attend a walk-in orientation and are required to take the Test for Adult Basic Education (TABE). After 15 weeks, students will have received their CompTIA A+ and Microsoft Technology Specialist certification. Through job placement services, Per Scholas works extensively with students to find employment up to two years after graduation.

The students all come from low-income backgrounds but the demographic is diverse. Students range in age from 18 to 55 years with a variety of job and technology experience. Some hope to work as IT technicians after graduation, while others want to join nonprofits like Per Scholas to help those in need.

Per Scholas student Anatashe Alli, a high school graduate and mother, hopes to use her passion for computers to work in Cablevision and support her son, and then move on to government: the FBI.

?They?re kind of opening doors for me, so that?s really why I?m at Per Scholas,? Alli said, ?Technology is always upgrading every year so you never know what?s coming next.?

After losing his job in retail, Juan Rodriguez became frustrated with finding office work until he enrolled in Per Scholas. Now he says that the program provided him with the technology tools and life skills he needs to transition successfully into an office environment.

Per Scholas also has specialized programs and partnerships with veterans? and women?s organizations to assist ?veterans and women hoping to work in IT. Per Scholas reserves a portion of class seats for U.S. veterans, and is establishing partnerships with corporations such as JPMorgan Chase and Time Warner Cable to ensure veteran employment. The women?s program lasts for 18-20 weeks instead of the traditional 15 weeks, to accommodate for family obligations and childcare.

MetroFocus host Rafael Pi Roman spoke with Per Scholas CEO Plinio Ayala about the costs and benefits of a technology education.

?The cost for us is about $5,000 an individual, so when we raise the money for that individual, we want to make sure that they?re ready for this experience,? Ayala said about the application process. As a nonprofit, Per Scholas is completely comprised of volunteers, and receives funding from corporations, foundations, and state and city government. According the Ayala, the education is an important response to the rapid growth in the city?s technology sector.

?I believe the jobs are there,? he said, ?Everything that we do in this program is based on the feedback we get from the employer community, and that?s why I believe we?re as successful as we are.?

Per Scholas also partners with IT Asset Disposition service companies in its Asset Recovery Program, which helps clients dispose of used computers and technology and provide for those that need it. A portion of the revenue goes to funding all of their other programs. Clients have included companies like Con Edison, Fox Cable News, and Metro-North.

According to Ayala, 85 percent of the students graduate and 85 percent of the graduates find employment. This year Per Scholas hopes to open a new location in Columbus, Ohio,? to start expanding its technology services and education across the nation.

Turkish, Syrian forces seek downed Turkish jet

ANKARA/BEIRUT (Reuters) - Turkey and Syria said their navies were jointly searching on Saturday for Turkish airmen shot down by Syria over the Mediterranean, while nearby Turkish authorities were hosting thousands of rebels fighting President Bashar al-Assad.

Signals from both sides suggested neither wanted a military confrontation over Friday's shooting down of the jet near sea borders of both states. However, the joint operation will clearly sit uneasily with both forces, given the bitter hostility between the two former allies over Assad's 16-month crackdown on opponents.

Turkey has promised to respond decisively.

"It is not possible to cover over a thing like this. Whatever is necessary will no doubt be done," Turkish President Abdullah Gul told reporters, adding that Ankara had been in telephone contact with Syrian authorities.

The incident, whatever its causes, demonstrated Syria's formidable Russian-supplied air defenses - one of the many reasons for Western qualms about any military intervention to halt bloodshed in the country.

Turkey's Deputy Prime Minister Bulent Arinc said the downed jet was not a warplane but a reconnaissance aircraft, state television TRT reported. Turkish media had earlier identified it as an F-4 Phantom, a fighter also used for reconnaissance

Gul said it was routine for fast-flying jets to cross borders for a short distance and that an investigation would determine if the aircraft was brought down in Turkish airspace.

Syria's military said the Turkish plane was flying low, just one kilometer off the Syrian coast, when it was shot down. It had been tracked at first as an unidentified aircraft and its Turkish origin established subsequently.

"The navies of the two countries have established contact. Syrian naval vessels are participating along with the Turkish side in the search operation for the missing pilots," it said.

With the second biggest army in NATO, a force hardened by nearly 30 years of fighting Kurdish rebels, Turkey would be a formidable foe for a Syrian military already struggling to put down a popular uprising and an increasingly potent insurgency.

"PLAYING WITH FIRE"

Turkish Foreign Minister Ahmet Davutoglu met Turkey's military commanders and intelligence chief to discuss the search for the pilots and Ankara's next steps.

The meeting followed an emergency security session chaired by Prime Minister Tayyip Erdogan on Friday evening.

"Turkey will present its final stance after the incident has been fully brought to light and decisively take the necessary steps," said a statement from Erdogan's office.

Turkish newspapers were less restrained.

"They (the Syrians) will pay the price," said Vatan, while Hurriyet daily said: "He (Assad) is playing with fire."

The joint Syrian-Turkish naval operation was not without its tense ironies. Less than 50 Km (30 miles)away in Turkey's southeastern Hatay province, authorities are giving refuge to the rebel Free Syrian Army who mount daily attacks on Syrian government forces.

Saudi Arabia and Qatar are paying salaries to Syrian rebels, with Turkish involvement, an Arab diplomat in Jeddah said.

"The payment has been going on for months and the agreement was made on April 2 by Saudi Arabia and Qatar, with logistical organization from Turkey where some Free Syrian Army factions are based," he said, asking not to be named.

"The point of this is to encourage as many factions of the Syrian army to defect and to organize the FSA, control it and prevent any extremist organizations from joining it."

A spokesman for Saudi Arabia's foreign ministry said he was not aware of reports that the kingdom was funding Syrian rebels.

The souring of Syrian-Turkish relations has provoked concern among Turks that Syria may revive its former support for Kurdistan Workers Party (PKK) insurgents in southeastern Turkey.

"It's possible the Turks were sending jets in the area in response to an apparent escalation of the PKK's activities," Hilal Khashan, political science professor at the American University of Beirut, told Reuters. "Turkey may suspect that Syria and Iran are supporting Kurdish rebel activities now as a reaction to Turkish support of the Syrian revolt."

However, Khashan said he did not expect a harsh military reaction from Turkey. "It is under a tight leash by the United States. They don't want to start a war tomorrow."

A civil war, or something closely resembling one, is already in full swing in Syria, where fighting or shelling engulfed parts of the cities of Aleppo, Hama, Homs, Deir al-Zor and Douma, according to the Syrian Observatory for Human Rights.

The British-based watchdog also reported fierce clashes and shelling in the town of al-Bab in Aleppo province, where army helicopters were flying overhead. It said rockets and gunfire had killed three people in al-Qusair, a town in Homs province. Two men were killed in an ambush by security forces in Hama.

Syrian army shelling killed at least 28 people in Deir al-Zor, opposition activists said. A hospital source said three women and several children were among civilians killed when shells hit their homes in the Old Airport area.

The International Committee of the Red Cross (ICRC) said it was still negotiating access to hundreds of trapped civilians and wounded people in Homs after a failed attempt to reach them on Thursday. "We are still in discussions to try to enter the (old) city," ICRC spokesman Jean-Yves Clemenzo said in Geneva.

Turkey fears the fighting, much of which pits majority Sunni Muslim dissidents and rebels against Assad's Alawite-dominated security forces, could unleash a flood of refugees over its own border and ignite a regional sectarian conflict.

It already hosts 32,000 Syrian refugees near the border. The opposition Syrian National Council meets in Istanbul.

Ankara has previously floated the possibility of setting up some kind of safe haven or humanitarian corridor inside Syria, which would entail military intervention, but has said it would undertake no such action without U.N. Security Council approval.

Turkey has said however that Assad must go.

It was unclear why the Syrians had shot down the aircraft, which, having left a base in Malatya, was flying close to a corridor linking Turkey with Turkish forces on Northern Cyprus.

"The Syrian military may have taken a calculated gamble by downing the Turkish plane, which could boost the morale of Assad's loyalists after increased defections from the military," said Yasser Saadeldine, an opposition Syrian commentator.

"A Turkish retaliation would fit into the fantasy he (Assad) is peddling that the uprising is a foreign conspiracy."

It was also possible the air defenses could have mistaken the aircraft for a defecting pilot, following an incident earlier in the week when a Syrian aircraft landed in Jordan.

Russia and China, Assad's strongest backers abroad, firmly oppose any outside interference in the Syrian crisis, including foreign arming or funding of insurgents, saying envoy Kofi Annan's stalled peace plan is the only way forward.

Assad's prime minister, appointed after a parliamentary election conducted last month despite the violence convulsing the country, named a new cabinet on Saturday, retaining the same interior, defense and foreign ministers.

Washington Capitals trade Cody Eakin at NHL entry draft

Mike Ribeiro, acquired in a trade with the Dallas Stars during Friday night?s first round of the 2012 NHL entry draft, may fill the role of No. 2 centerman for the Washington Capitals.But he came at the cost of forward Cody Eakin, who produced 13 goals and 14 assists in 43 games with the Hershey Bears as a rookie in 2011-12.

In a whirlwind day of NHL trades, the Caps also made two first-round picks at CONSOL Energy Center in Pittsburgh, taking Swedish centerman Filip Forsberg at No. 11 and Plymouth (OHL) winger Tom Wilson at No. 16.

Forsberg was ranked the No. 2 prospect in the draft by The Hockey News and No. 3 by TSN, but he fell to No. 11 as eight defensemen went in the first 10 picks.

The 6-4, 195-pound power forward Wilson had 27 points and 141 penalty minutes in 49 games last season.

The Pittsburgh Penguins and Carolina Hurricanes brokered a major trade. Pittsburgh sent Jordan Staal to Carolina for the No. 8 pick, 2007 first-rounder Brandon Sutter and Boston College defenseman Brian Dumoulin, a 2009 second-rounder.

Staal, who had one season remaining on his contract and turned down a contract extension offer by Pittsburgh, will get to play with his brother Eric in Carolina.

With the No. 20 pick, Philadelphia took Oshawa (OHL) centerman Scott Laughton.

Calgary Flames GM Jay Feaster, former general manager of the Bears, also made a trade. The Flames gave their No. 14 pick to the Buffalo Sabres in exchange for a first-round pick (No. 21) and a second-rounder (No. 42).

At No. 21, Calgary selected high school centerman Mark Jankowski.

With the No. 1 overall pick, the Edmonton Oilers selected Sarnia (OHL) winger Nail Yakupov, a native of Russia.

Iran sanctions trap Apple clerks, customers alike

An Apple store employee refused to sell an iPad to an Iranian American customer, citing company policy that aims to comply with U.S. sanctions on trade with Iran, WSBTV in Atlanta reported this week. The customer left empty-handed, in tears, and complained of discrimination to the reporter.

The case is more complicated than that, legal experts say. The incident and others like it highlight a dilemma created by the U.S. trade embargo against Iran ? and other sanctioned countries, including Cuba, Syria and North Korea ? which makes even the humblest sales associate responsible for enforcing the embargo?s provisions.?

?

Those employees ? as well as the store and the company ? could be hit with civil and criminal penalties if they sell products to customers who they have reason to believe will export them to Iran in violation of the embargo, legal experts say. But if the same clerk refuses service on the basis of the customer?s language or ethnic background, they may run afoul of civil rights laws.


"If I walked in and told them I want to buy this and send it to a friend in Iran or Cuba, they can?t sell it to me," said Clif Burns, an export control attorney at Bryan Cave, a law firm in Washington, D.C. "If they had that information, they were absolutely within their rights" to refuse the sale.

"The tricky question is if you hear someone speaking Farsi?(also called Persian)?? then the issue is: Should you be more alert to the possibility that they might export the item to Iran? And by being more alert in that situation are you in violation of civil rights statutes? It?s not any easy question."

Under U.S. sanctions against Iran ? dating to 1987 and expanded several times since ? exports to the Islamic republic are illegal, with exceptions for items in a few limited categories, such as books, movies, agricultural goods, medicine and medical supplies. These sanctions are enforced by the U.S. Treasury Department's Office of Foreign Assets Control and the U.S. Commerce Department?s Bureau of Industry and Security. Sanctions are not intended to affect the sale of goods used in the United States.

"There is absolutely no U.S. policy or law that would prohibit Apple or any other company from selling its products in the United States to anyone intending to use the product in the United States, including Iranians and Persian-speakers," said Pooja Jhunjhunwala, a spokesperson for the U.S. State Department.

But the government does not spell out how an individual working in a retail store should judge whether a customer intends to send or carry a product to a country under sanctions, and technically the onus could fall on store clerks. And Burns says anyone in the chain who touches a transaction that violates of the sanctions can be held liable if they knew or should have known that the item was being shipped to a sanctioned country.

"The standard applies to the retail clerk, shipping manager, corporate headquarters," said Burns.

Individuals can be fined up to $250,000 and up to five years in prison for export sanctions violations. Corporations can be hit with a $1 million criminal penalty, he said. "In theory there?s no intent (to commit a crime) requirement. They will look at whether you knew or should have known."

In reality, there are only a few reported cases of retailers denying individual sales on this basis, all involving Iranian Americans and Apple stores.

Apple: Silence
Apple did not?initially respond?to requests for comment.

After this report published, Apple spokesman Steve Dowling contacted msnbc.com with the following statement:

"Our retail stores are proud to serve customers from around the world, of every ethnicity. Our store teams are multilingual and diversity is an important part of our culture. We don't discriminate against anyone."

In the case of Sahar Sabet, from the WSBTV report, who was refused purchase of an iPad at an Apple store in Alpharetta, Ga., some of the facts are unclear. She said the clerk refused to sell her an iPad after hearing her speak Farsi with her uncle. The iPad was intended as a gift for her cousin in Iran, according to the report, but it was unclear how or if the clerk was aware of that.

Calls to Sabet were not returned. A call to the Apple store at North Pointe Mall in Alpharetta was referred to corporate headquarters.

A second Iranian American interviewed in the report also said he was barred from purchasing something at an Apple store in the Atlanta area when he was helping an Iranian student buy an iPhone. Zack Jafarzadeh said he and the friend were speaking Farsi when the sales rep denied their purchase. "We never talked about him going back to Iran or anything like that," Jafarzadeh said, according to the report.

The Council on American Islamic Relations, a non-profit rights group, says it was in discussions with Apple to revise its policy even before this week's news story, because of a complaint from an Iranian American who was refused a purchase in an Apple store in northern California in March.

In that case, a sales associate refused to sell him anything ? even things he was buying for his own use ? after he mentioned that he intended to send an iPod Nano to Iran as a gift for a relative, Rachel Roberts, civil rights coordinator for CAIR, told msnbc.com.

"He claims that when he asked the associate how he could get the items he needed, she told him to go to a different Apple store if he wanted service and to not reveal that he is Iranian," Roberts said ? adding that he found that answer to be degrading and inconsistent. Ultimately the store made an informal apology and sold him items for his personal use, Roberts said.

"The concern ? is how store employees balance their obligations under embargo law and civil rights laws," said Zahra Billoo, an attorney for CAIR in San Francisco, adding that the U.S. government should clarify how retail stores should comply. The other concern, she said, is "how employees are being trained to implement this."

Apple's policy regarding sanctions, published on its website, is closely tailored to the language of the U.S. trade law itself.

The National Iranian American Council, a nonprofit organization, said the Apple stores were "overzealously enforcing the sanctions." "In singling out Persian-speakers for interrogation about how they intend to use Apple products, these Apple employees are clearly engaging in racial profiling," the group said in a statement.

But the group provided a fact sheet on sanctions and conceded that "it also appears to be the case that many Iranian Americans do not understand the implications of how U.S. sanctions on Iran affect them."

The very notion that sales clerks could have to make decisions on purchases under the sanctions raised red flags for?some observers.

"The responsibility for enforcement should fall on border patrol, law enforcement, the U.S. post office, customs -- government agencies," said Nahal Iravani-Sani, president of the Iranian American Bar Association. As it is, the law "promotes dishonesty and invites profiling.?When you come down to it, it's absurd."
